LESSOR HEREBY RENTS TO HIRER(S) AND HIRER TAKES ON RENTAL THE MOTOR VEHICLE (HEREIN CALLED “VEHICLE”) SUBJECT TO ALL THE TERMS AND PROVISIONS OF THIS AGREEMENT

Definitions

Michael’s Garage means the vehicle rental supplier shown on Lease Agreement. Every reference to Michael’s Garage refers to Ms Sylvana Gauci as the owner of the fleet.

Hirer means the person(s) signing this Agreement, any other person or entity to which charges incurred are billed, and any additional permitted driver with written consent from Michael’s Garage.

General Provisions

Michael’s Garage rents the motor vehicle as described in the Lease Agreement under all terms of this Agreement. Hirer agrees to return the vehicle in the same condition received, with all accessories, on the date and place specified. Michael’s Garage may re-inspect vehicles returned dirty or outside office hours. Hirers should inspect and photograph vehicles upon pickup and return. Inspections and photographic evidence are required in case of returns made outside working hours.

Unauthorised & Prohibited Use

The vehicle will not be used, and insurance becomes invalid, under the following conditions:

Passenger transport for hire or reward.
Illegal purposes, racing, towing, or unsuitable roads.
Driven by anyone not listed or without a valid license.
Drivers under influence of drugs, alcohol, or impaired ability.
Violence or fraud towards company staff results in contract termination.

Insurance

CDW does not cover windows, tyres, interior damage, keys, fuel misuse, personal items, etc. Theft waiver excludes booster seats, keys, GPS. Hirer must report damage or mechanical issues immediately. Zero excess only covers one damage under CDW scope. Insurance void if vehicle driven in unsafe condition or not reported.

Liability & Mechanical Failures

Michael’s Garage maintains vehicles to manufacturer standards but is not liable for mechanical failures. All claim charges, excesses, and admin fees are payable by the hirer. Death or injury cover is capped under Maltese law. Drivers are not insured.

Preauthorisation

A preauth of minimum €100 (credit) or €200 (debit) is required. Michael’s Garage can extend or repeat preauth if necessary. The hirer authorizes Michael’s Garage to charge their card if unpaid by a third party after 90 days.

Cancellation Policy (25 days or less)

24–72 hrs before: 50% rental charge
Within 24 hrs / no-show: full charge

Applicable Charges

Fines: Hirer liable for all fines. €10–€15 admin fee applies per offence.
Accidents: €59 admin fee, €100 immediate repair fee if undriveable.
Fuel: €10 admin fee for underfilled tank plus missing fuel cost.
Excess Dirt: From €20. Up to €150 for seat stains or odours. Smoking not allowed.
Extension: Must be notified in advance. Late return fees apply: €30 (Gozo), €50 (Malta).
Other Fees: Admin fees apply for locked keys, dead battery, prohibited parking, etc.

All charges must be paid at the conclusion of rental. Credit card holders authorize Michael’s Garage to adjust invoices if errors are discovered post-audit.
